Subjective Torture

In an interview with the New Yorker, Director of National Intelligence Mike McConnell said that waterboarding “would be torture” if used against him, but still declined to say whether the technique should be legally classified as torture:
Obviously if Waterboarding was used against the Director of National Intelligence it would be torture. But when you're waterboarding other people? Well that's an entirely different story, especially if they're brown, I mean you can do whatever you like to those cave dwellers right?
